Owners of ex-Railyard restaurant ordered to pay $471K for back rent

The owners of a former burger restaurant in the Railyard have been ordered to pay its former landlord $471,099 for back rent and interest. 

This week, Lancaster County District Judge Lori Maret entered the judgment against MVPZ and Me LLC, which did business as BurgerFi, and Michael Miller of Shelby County, Tenn., in favor of TDP Phase One LLC.

The defendants didn’t appear at a hearing Monday on the motion for summary judgment.







BurgerFi closed its Lincoln location at Canopy and Q streets in The Railyard in 2020.




BurgerFi’s owners surrendered the property at 300 Canopy Street in December 2020. The company took out a 10-year lease in 2015 but closed in March 2020.

According to an order this week, TDP Phase One LLC has taken steps to mitigate its damages by listing the Railyard property for lease on Crexi.com and MRCI, two commonly-used commercial real estate listing platforms.

WRK LLC, which manages the property, has shown the site to more than 10 interested parties and continues to reach out to individuals and businesses that have shown interest. They also pitched the site at ICSC, the largest gathering of retail and commercial real state professionals in the U.S.

But the location remains vacant.

“While WRK and plaintiff are seeing some increased interest for operation of bar/restaurant concepts, demand for the property remains lower due to multiple spaces available in the downtown Lincoln area due to the closure of businesses during the pandemic,” according to the order.

Maret found that TDP Phase One was entitled to damages for unpaid rent for June 1, 2021, through April 2024.
