Google LLC will go to trial in San Francisco federal court over claims that it illegally accessed data from the popular period and fertility tracking app Flo Health.
Judge James J. Donato on Monday ruled that only a jury could determine whether the tech giant violated federal and California state privacy laws by obtaining Flo Health Inc. users’ sensitive health information through Google’s software developer kit without consent. Donato rejected Google’s arguments that the proposed class of users didn’t have standing to sue because it didn’t target them with personalized ads based on health data.
